Is an Au pair agency compulsory? Although this does not directly affects the insurance, we would like to pay some attention to this subject. Officially the au pair, according to regulations of the IND, ought to arrive in The Netherlands through a licensed au pair agency. These regulations are applicable to both au pairs from outside the European Union as au pairs who live in EU countries.
Au pairs that live in a country outside the European Union need to take the visa procedure. For au pairs that live in a European country, there is no visa requirement to enter the country. However, if you don’t use a licensed agency, you can also not profit from the guidelines of the au pair policy. After all, you don’t have a document to show that you are a host family, and that the au pair is actually staying with you as part of the exchange program.
Usually the relationship is then considered to be employer- employee which would mean that you will have to pay the au pair minimum wage, holiday allowance and you would have to pay for social security. If you don’t, then you risk (tremendous) fines, since you are not being a good employer. In this situation there is no way to prove that your employee, is actually an au pair who lives with you as part of the official au pair program.
